Welcome to Domico PropTech Private Limited ("Domico", "we", "our", "us"). These Terms & Conditions ("Terms") govern your access and use of our platforms, products, and services, including:

• Website: www.domico.in
• Mobile Application(s): Domico App
• CRM & Software Tools: Domico CRM and related services
• Property discovery, property listings, lead generation, subscriptions, promotions, customer support, and communication services.

By accessing, browsing, registering, or using Domico in any manner, you agree to be bound by these Terms. If you do not agree, please do not use Domico.

1. DEFINITIONS

• "User/You" means any person or entity using Domico, including buyers, sellers, tenants, landlords, builders, brokers, agents, and partners.
• "Platform" means Domico website, app, CRM tools, and associated services.
• "Listing" means any property or project details displayed on Domico.
• "Partner" means any builder, broker, agent, owner, or business listing properties or using Domico services.
• "Services" include lead handling, CRM, subscriptions, marketing services, support, and technology features.

2. ELIGIBILITY & ACCOUNT RESPONSIBILITIES

2.1 You must be 18 years or older to use Domico.

2.2 If you create an account, you are responsible for:

• Providing accurate information
• Maintaining confidentiality of login credentials
• All activity performed through your account

2.3 Domico may refuse, suspend, or terminate accounts that contain false details or show suspicious activity.

3. DOMICO'S ROLE

3.1 Domico is a technology and service platform that helps connect Users with property information and Partners.

3.2 Domico may provide:

• Listing display & promotion
• Enquiry management, site visit coordination, and CRM tools
• Communication support (call/WhatsApp/SMS/email)

3.3 Domico does not:

• Act as a property owner, developer, broker (unless explicitly agreed in writing), legal advisor, or financial advisor
• Guarantee property availability, price, possession dates, approvals, or outcomes
• Verify title/ownership in a legally binding manner

4. MANDATORY VERIFICATION BY USERS (YOUR RESPONSIBILITY)

4.1 Property transactions carry legal and financial risk. Before making any payment, booking, or agreement, you must independently verify:

• Ownership/title/chain documents
• Encumbrances (loan/lien), court disputes, notices
• RERA registration (where applicable)
• Permissions, sanctions, occupancy/completion certificate
• Area, layout, amenities, and project specifications

4.2 Domico is not responsible for losses arising from failure to verify the above.

5. LISTINGS, CONTENT & ACCURACY

5.1 Listings and information shown on Domico may be provided by Partners, owners, builders, brokers, or public sources.

5.2 While we attempt to improve quality, Domico does not guarantee that any listing is:

• Fully accurate, complete, or updated
• Available at the time of enquiry
• Free from errors, misrepresentation, or omissions

5.3 Prices, offers, inventory and availability may change without notice.

6. PROHIBITED CONTENT & ACTIVITIES

You agree that you will not:

• Post fake, misleading, duplicate, illegal, or stolen listings/content
• Use Domico for fraud, impersonation, harassment, or spamming
• Scrape data, copy platform content, or misuse leads
• Interfere with platform security, reverse engineer, or attempt unauthorised access

Domico may suspend accounts, remove content, block access, and take legal action.

7. LEADS & COMMUNICATION CONSENT (CALLS/WHATSAPP/SMS/EMAIL)

7.1 By submitting your details, you consent to be contacted by:

• Domico
• Domico authorised teams
• Relevant Partners (builder/broker/owner/agent)

via call, WhatsApp, SMS, email, and push notifications.

7.2 Communication may include:

• Property details, follow-up, site visit coordination
• CRM/service notifications
• Offers and updates (you may opt-out from promotional communication)

8. PAYMENTS, TOKEN, BOOKING & DEAL RESPONSIBILITY

8.1 Domico may facilitate communication, scheduling, lead transfer, marketing, and payment links for Domico services.

8.2 Unless clearly stated in writing, Domico is not a party to property sale/lease agreements between users and partners.

8.3 Any booking/token amount paid to a builder/seller/broker is subject to their terms and conditions.

8.4 Domico is not responsible for cancellation/refund disputes between transacting parties.

9. SUBSCRIPTION PLANS (CRM / LISTINGS / PREMIUM SERVICES)

9.1 Domico may offer paid plans, including:

• CRM subscriptions
• Builder/project listing packages
• Premium listings, featured slots, promotional packages
• Automation/WhatsApp/calling add-ons

9.2 Plan benefits, validity, and pricing are shown at purchase or in the invoice/order document.

9.3 Users must not share paid access, resell, or misuse Domico software/services without written permission.

10. REFUNDS & CANCELLATIONS

10.1 Unless explicitly mentioned in writing, subscription fees are non-refundable once the service is activated or consumed.

10.2 If Domico publishes a separate Refund Policy, it will form part of these Terms.

10.3 Domico may deny refunds in cases of:

• Violation of Terms
• Misuse, fraud, or suspicious activity
• Chargebacks without a valid reason

11. PARTNER RESPONSIBILITIES (BUILDERS/BROKERS/AGENTS/OWNERS)

If you are a Partner listing on Domico, you agree that:

• You have the legal authority to list the property/project
• You will provide truthful, verified information
• You will not mislead users on pricing, approvals, possession, or availability
• You will respond professionally to leads and not misuse user data

Domico may suspend Partner accounts for repeated complaints or false listings.

12. SERVICE PROVIDERS & PARTNER SHARING

To deliver services smoothly, Domico may share relevant user enquiry details with:

• Builders, brokers, agents, property owners
• Payment gateways
• Communication providers (SMS/Email/WhatsApp/calling)
• Cloud hosting and analytics providers
• Authorised service partners who support Domico operations

Domico shares only what is reasonably required to provide services and improve user experience.

13. RIGHT TO MODIFY, CORRECT, REMOVE CONTENT

Domico may, at its discretion:

• Modify, correct, update, or remove listings, content, pricing, offers, or service information
• Suspend, limit, or restrict access to any part of the Platform
• Remove content that violates these Terms or appears misleading/suspicious

Domico is not responsible for any losses arising due to such modifications or removals, where permitted by law.

14. INTELLECTUAL PROPERTY

14.1 Domico owns its platform design, branding, software, UI, CRM tools, and original content.

14.2 Users may not copy, reproduce, sell, or distribute Domico materials without written permission.

14.3 If you submit any content to Domico (images/videos/details), you grant Domico a limited right to use it for display, marketing, and platform operations.

15. PLATFORM AVAILABILITY & SERVICE LIMITATIONS

15.1 Domico may occasionally face downtime due to maintenance, upgrades, technical issues, or third-party outages.

15.2 Domico does not guarantee uninterrupted availability of the Platform at all times.

15.3 Domico may modify, pause, or discontinue features at its discretion.

16. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

• Domico is not liable for any indirect, incidental, special, or consequential losses
• Domico is not liable for disputes between buyers/sellers/partners
• Domico is not responsible for financial loss, legal disputes, or project changes by third parties
• Domico is not responsible for any incorrect listing information provided by partners/users

Use of Domico is at your own risk.

17. INDEMNITY

You agree to indemnify and hold Domico harmless against claims, liabilities, losses, and expenses arising from:

• Your violation of these Terms
• Your misuse of the platform
• Your transactions or disputes with any third party
• Your uploaded content and representations

18. SUSPENSION & TERMINATION

Domico may suspend or terminate your access without prior notice if:

• You breach these Terms
• Your activity appears fraudulent or harmful
• You misuse paid plans or lead data

Domico may also remove listings/content that violate policies.

19. PRIVACY

Your use of Domico is also governed by our Privacy Policy, which explains how we handle your data. By using Domico, you consent to our data practices.

20. CHANGES TO TERMS

Domico may update these Terms from time to time. Updated Terms will be posted with a new "Last Updated" date. Continued use after updates means you accept the revised Terms.

21. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts located in Indore, Madhya Pradesh.
